These terms are a binding agreement between you and E. zona, MB ("FabiRide", "we", "us"). They govern your use of the FabiRide mobile app, the FabiRide display device, the FabiRide smart battery, and the cloud services that connect them.
By ticking the acceptance box when you create an account, by signing in, or by pairing a Display, you accept these terms in full. If you do not accept them, do not create an account and do not use the Services.
Read sections 6 to 13 carefully. They describe what FabiRide is not, the risks you take on when you ride, and the limits of what we are responsible for. They are the reason we can offer the Services at all.
1. Definitions
App — the FabiRide mobile application (iOS / Android) and the FabiRide web portal at https://my.fabiride.com.
Display — a FabiRide display device you own or are authorised to use.
Battery — a FabiRide smart battery pack, where supplied.
Cloud — the FabiRide servers backing the App, the Display and the Battery.
Services — the App, Display, Battery and Cloud, collectively, plus any firmware, documentation and support we provide with them.
Bike — the electric bicycle, e-motorcycle, scooter or other vehicle you connect a Display to.
Controller — the motor controller fitted to your Bike (for example SiliXcon, ASI/BAC, Fardriver, Bafang, VESC, Talaria, Sur-Ron, King-Meter, KT or any other make).
Supported Configuration — a combination of Bike model, Controller make, Controller firmware version and wiring that FabiRide has published as supported, at the Display hardware and firmware versions you are running. Anything else is an Unsupported Configuration.
Rider Aids — the speed limiter, global caps, traction control, wheelie assist and balance assist, cruise control, engine braking and brake-curve features, thermal limits, phone-as-key, crash detection and SOS, and every other assistive or protective function of the Services.
Content — anything you transmit through the Services, including voice audio in crew chat, ride names, photos, invoice scans and support messages.
2. Who may use the Services
You must be 16 years or older to create an account.
You must hold every licence, registration, insurance and permission your country requires for the Bike you ride, and you must meet the minimum age for that vehicle class — which is often higher than 16.
You must be legally able to enter into a contract.
If you let a minor use a Bike fitted with a Display, you are fully responsible for that minor's use, for supervising them, and for the limits you set on their account.
We may refuse, suspend or close any account at our discretion where we reasonably believe these terms have been breached.
3. Your account
One account per person. Do not share your password. To let someone else ride, use the Invite rider feature instead of handing over credentials.
You are responsible for everything done under your account, including by anyone you give access to.
Keep your email address current — it is how we send security notices, ownership transfers and terms changes.
Tell us immediately at info@fabiride.com if you believe your account or a Display has been compromised.
4. Accepting these terms and recording your acceptance
When you create an account you must tick the acceptance box. We record the version of these terms you accepted and the timestamp, and store it against your account. You can read the current version at any time at https://my.fabiride.com/legal/terms or in the App under More ▸ Help & support ▸ Legal.
5. What FabiRide is — and what it is not
FabiRide is an aftermarket display, telemetry and configuration tool. It shows you information, records your rides, and — where your Controller supports it — lets you read and write Controller settings.
FabiRide is not:
a safety device, a protective device or personal protective equipment;
a braking system, a stability system, or any part of the Bike's safety-critical hardware;
a homologation, type-approval, certification or roadworthiness authority;
a substitute for your own judgement, your own inspection of the Bike, or professional service by a qualified technician;
a guarantee that your Bike, your Controller or your battery is safe, legal or fit to ride.
The Display does not ride the Bike. You do.
6. Compatibility, fitment and unsupported configurations
FabiRide equipment is designed and tested against specific Bikes, Controllers, Controller firmware versions and wiring configurations. We publish which combinations are supported, and that list changes over time.
6.1 It is your responsibility to check compatibility
Before you fit or use a Display, a Battery or any FabiRide accessory, you are responsible for confirming that your exact Bike model, model year, Controller make, Controller firmware version, wiring loom and battery are a Supported Configuration. If you are not sure, ask us at info@fabiride.com before you fit anything.
6.2 Unsupported configurations are entirely at your own risk
If you use the Services on an Unsupported Configuration — including but not limited to:
a Bike model, brand or vehicle type FabiRide has not listed as supported;
a different model year, hardware revision or regional variant of a supported Bike;
a Controller make, model or firmware version FabiRide has not listed as supported;
a Bike whose Controller, motor, battery, BMS, wiring, throttle, brakes or sensors have been replaced, modified, repaired or retrofitted by anyone other than the original manufacturer;
a Bike modified beyond its original specification, including power, voltage, current, gearing, wheel size or firmware changes;
a homemade, kit-built, converted or salvaged vehicle;
then you accept all risk arising from that use, and FabiRide accepts none. We give no warranty of any kind that the Services will work, read correct values, write correct values, or behave safely on an Unsupported Configuration, and we are not liable for any resulting damage, malfunction, injury, loss or cost.
6.3 We may block unsupported use
The Services may detect an Unsupported Configuration and restrict functionality, refuse to write settings, or display a warning. Absence of a warning is not confirmation that your configuration is supported.
6.4 Damage to your Bike, Controller or battery
Connecting third-party electronics to a vehicle carries risk. Incorrect wiring, incompatible voltages, incompatible protocols, damaged connectors and out-of-specification settings can damage your Controller, motor, battery, BMS or wiring loom. Except as required by mandatory consumer law, we are not liable for damage to your Bike or to any third-party component, and such damage is not covered by the Display warranty.
7. Installation — and what fitting FabiRide does to your Bike's warranty
7.1 Have it fitted professionally
FabiRide equipment is designed to be straightforward to install, but we strongly recommend having it fitted by a qualified professional. That is the only way to be sure every connection is correct and every function behaves as intended.
Improper installation can damage the Display, the Battery, your Controller, your motor or your battery pack, and will void the FabiRide warranty on any part it damages. Damage caused by negligent installation, miswiring, unauthorised modification, or bench-testing outside our documented procedure is not a warranty defect.
7.2 What you are responsible for
Fitting a Display or Battery to a Bike is a modification to a vehicle. Follow our installation documentation exactly.
Secure mechanical mounting, correct polarity, correct connectors, fusing, strain relief, waterproofing, and cable routing that cannot foul the steering, wheels, brakes or drivetrain.
Checking your work before every ride, and re-checking after any crash, service, wash or transport.
Not operating the App while riding. Stop the Bike, in a safe place, before changing any setting.
7.3 Fitting FabiRide makes your Bike a non-stock bike
FabiRide displays, batteries and accessories are aftermarket parts. They are not original equipment supplied or approved by Sur-Ron, Talaria, Segway, Bosch, Shimano, Specialized, or any other bike or component manufacturer, and no such manufacturer endorses, certifies or supports them.
For as long as they are fitted, non-original parts make your Bike a non-stock vehicle rather than a stock one (removal is covered in §7.4). You accept that this may, on its own and regardless of whether anything goes wrong:
Void or reduce the Bike manufacturer's warranty, in whole or for the affected systems. Many manufacturers exclude warranty on any vehicle fitted with third-party electronics or on any vehicle whose controller settings have been altered. Some can detect it.
Void or reduce your dealer's warranty or service agreement.
Void, reduce or invalidate your insurance, including third-party liability cover — potentially leaving you personally liable for injury or damage you cause to others.
Make the Bike non-compliant with road-safety and type-approval regulations, and therefore illegal to use on public roads. See §11.
Affect resale value and roadworthiness inspection.
Check with your bike manufacturer, your dealer and your insurer before you fit anything. It is your responsibility to know and follow the rules that apply where you live and ride. FabiRide is not responsible for any warranty, insurance, registration, inspection or legal consequence of fitting our equipment to your vehicle, and we do not compensate for a warranty or insurance claim that is refused because of it.
7.4 Removing it
A Display fitted as documented is a plug-in accessory. If you remove it and you have not changed any Controller setting, your Bike goes back to the condition it was in before: nothing is left behind, nothing has been permanently altered, and it is a stock bike again.
Removal does not undo three things:
Controller settings you changed. Speed caps, current and power limits, calibration values, modes and any other parameter you wrote live in the Controller, not in the Display, and stay there after the Display is gone. Reverting them is manual and is your responsibility — write down your original values before you change anything.
Permanent alterations made while fitting — cut or spliced wiring, drilled mounts, replaced connectors, an original display that was removed. Those are physical changes to the Bike.
What already happened while it was fitted. A crash, a warranty claim, an insurance event or an offence that occurred while the Bike was non-stock is judged on the Bike's condition at that time, not after removal.
In short: clean installation, stock settings, clean removal — stock bike. In any other case, restoring the Bike to stock condition is your responsibility.
8. Tuning, limits and Rider Aids — you choose the values
The App may let you read and write Controller parameters such as speed caps, current and power limits, throttle response and calibration, regenerative-braking and brake curves, thermal cut-offs, traction control, wheelie and balance assist, cruise control, gear ratios and wheel sizes.
These values are chosen by you. The App is the instrument you use to enter them; the effect they have on the Bike is produced by your Controller and your hardware.
You are solely responsible for every value you set, for understanding what it does, and for the consequences on your Bike, your battery, your drivetrain, other road users and yourself.
Defaults, presets, ranges, recommended values, calculated estimates and named modes (ECO / SPORT / HYPER and similar) are starting points and conveniences, not safety recommendations, and are not verified as safe for your Bike.
Raising a limit can overheat a motor, controller or battery, destroy a drivetrain, cause loss of control, or make the Bike illegal to ride on public roads.
Rider Aids are assistive functions, not safety systems. They can be inaccurate, delayed, or wrong. Never let a Rider Aid substitute for the brakes, your throttle hand, your attention or your judgement.
The speed limiter, global caps and traction control may fail to limit speed, power, current or wheelspin.
Wheelie assist and balance assist are experimental features that intervene in throttle output and may act unexpectedly.
Phone-as-key is a convenience, not an anti-theft device. Always use a physical lock.
Crash detection and SOS are best-effort and may fail to detect a crash, or fail to send an alert — for example with no phone signal, a flat battery, a damaged phone, or a crash the sensors do not recognise. Never rely on it as your only means of getting help.
If you are ever unsure what a setting does, leave it alone and ask us first.
9. Safety, assumption of risk, and your responsibility as a rider
Riding an electric bike or e-motorcycle is inherently dangerous and can cause serious injury, permanent disability or death — to you and to others. This is true on every Bike, in every configuration, with or without FabiRide fitted, and whether or not your configuration is supported.
By using the Services you acknowledge and agree that:
You ride entirely at your own risk. You voluntarily accept all risks of riding, including risks arising from the Bike, the road, the weather, other people, mechanical failure, electrical failure, software failure and your own actions.
Each rider is responsible for themselves. This applies to you, to anyone you invite as a shared rider or shared admin, and to anyone you let ride a Bike fitted with a Display.
FabiRide is not responsible for crashes, collisions, falls, loss of control, injury, death, fire, property damage, vehicle damage, fines, penalties, confiscation, prosecution or insurance loss, however they arise, on any Bike, supported or unsupported.
You will ride within the legal limits of your jurisdiction, within your own ability, and within the limits of the Bike.
You will always wear a helmet and appropriate protective equipment.
You will inspect the Bike — brakes, tyres, wheels, battery, wiring and fasteners — before riding, and you will not ride a Bike you have any reason to believe is unsafe.
You will not use throttle, power, wheelie, traction, cruise or limiter-off functions on public roads where doing so is unlawful or unsafe, and you will use them only in a controlled environment where you accept the consequences.
You will not ride while impaired, distracted, or while operating the App.
You will not use the Services for racing, stunts, timed runs or competition on public roads.
If a Rider Aid, a reading on the Display or any part of the Services behaves in a way that surprises you, stop riding and contact support before continuing.
10. Faults, failures and what we actually owe you
Software and connected hardware contain defects. Bluetooth links drop. Sensors drift. Telemetry can be wrong, late or missing. A limiter, cap or aid can fail to engage, disengage unexpectedly, or apply the wrong value.
The Services are provided "as is" and "as available", without any warranty that they will be uninterrupted, timely, error-free, accurate, or that any specific feature will work on your Bike.
Every value the Display shows is indicative. Speed, distance, odometer, range, battery percentage, state of charge, temperatures, power, current, voltage and efficiency are estimates derived from sensors and from your Controller. Do not rely on them where accuracy matters — for legal speed compliance, for range planning in a situation where running out is dangerous, or for any safety-critical decision.
If a feature fails, our responsibility is to fix it, not to compensate you. Where a defect is attributable to us, our remedy — in addition to your mandatory rights under §16 — is to investigate the report and, where we reasonably can, issue a corrected firmware or app update within a reasonable time. Reporting a fault does not entitle you to damages, refunds, replacement hardware, or compensation for any loss caused by the fault, except as §17 and mandatory consumer law require.
You must install updates. A fix only exists on a Display that has it. You are responsible for keeping the App and the firmware current; we will tell you in-app when an update is available. If you decline or defer an update, you accept the known behaviour it corrects, we are not responsible for problems it would have fixed, and we may treat a Display several versions behind as unsupported for that issue.
Support scope. We support FabiRide products. We do not provide support for third-party bikes, controllers, batteries, chargers, phones or apps, even when they are used with ours, and being unable to solve a third-party problem is not a defect in the Services.
We may change, suspend, degrade or withdraw any feature at any time, including features that exist today. We will give reasonable notice for material removals where we can.
Beta firmware and features marked experimental, beta or preview are provided with reduced testing and reduced safety guarantees, and you opt into them knowing that.
11. Legal compliance, road use and homologation
Electric-vehicle power, speed, pedal-assist and type-approval rules differ by country and are your responsibility to know and obey.
Changing a Bike's speed or power limits can remove its legal status as a bicycle or pedelec and turn it into a motor vehicle that requires registration, type approval, insurance, a licence plate and a driving licence. Riding it on a public road without those is a criminal or administrative offence in most countries.
Removing, raising or disabling a limiter, cap or restriction is your decision and your liability alone. FabiRide provides the tool; you decide whether and where using it is lawful.
Fitting our equipment and modifying a Bike can void the Bike manufacturer's warranty and your insurance, and can make the Bike illegal for road use — see §7.3. Check before you fit or modify.
You are responsible for any fine, penalty, seizure, prosecution, insurance refusal or civil claim arising from how you configure or ride your Bike.
You may not use the Services where doing so breaches export-control or sanctions law, and you confirm you are not on any applicable sanctions list.
12. Batteries and charging
Lithium battery packs store a large amount of energy and can catch fire or explode if abused.
Use only the charger specified for your pack, charge on a non-flammable surface, and never charge a pack that is damaged, swollen, wet or has been in a crash.
Never bypass, disable or reconfigure a BMS protection limit to a value outside the cell manufacturer's specification. Battery settings exposed in the App are for authorised configuration within safe limits, not for defeating protections.
Do not leave a charging pack unattended, and observe your local rules on indoor charging and storage.
We are not liable for fire, damage, injury or loss arising from charging, storage, transport, abuse, modification or misuse of any battery pack, or from any third-party pack, charger, cell or BMS.
13. Your acknowledgement
By ticking the safety acknowledgement when you create an account, you confirm that you have read and understood sections 5 to 12, and specifically that:
you ride at your own risk on every Bike, supported or not;
FabiRide is not liable for crashes, failures, injury, damage or fines;
if a limiter, traction control or any other feature fails, our remedy is a firmware fix, not compensation;
checking that your Bike and Controller are supported is your own responsibility;
fitting FabiRide makes your Bike non-stock and may void its manufacturer warranty, your insurance and its road-legal status, and you have checked this yourself.
14. The Display, firmware and source code
The Display is FabiRide hardware. The software running on it — firmware, source code, fonts, layouts, UI and assets — is licensed to you, not sold. We grant you a personal, non-exclusive, non-transferable, revocable licence to use it on the Display it was supplied with, for its intended purpose. All intellectual property in the Services remains ours.
You may not:
Extract, dump, decompile, disassemble, reverse-engineer, copy, publish or redistribute firmware or source code.
Reflash firmware that did not originate from FabiRide.
Bypass or defeat tamper protection, secure boot, flash encryption, entitlement checks, ownership gates or rider-access limits.
Sell, sublicense, rent or lend the software separately from the Display.
Use FabiRide branding, name or assets without written permission.
Anti-theft and source-code protection. The Display actively detects tamper and source-code-extraction attempts — for example attempts to read, dump or copy the firmware or source off the chip. If such an attempt is detected, the Display permanently and irreversibly disables itself, cannot be reactivated, and its warranty is void. The event is reported to FabiRide. Repeated or deliberate attempts may also result in account suspension and civil or criminal action. This is a deliberate security feature. Do not attempt to extract firmware or source code under any circumstances.
Nothing here restricts the decompilation rights you have under Article 6 of Directive 2009/24/EC for the purpose of achieving interoperability, where those rights apply and cannot be excluded by contract.
Third-party and open-source components. Our firmware and apps include third-party and open-source software, each governed by its own licence — which may grant you rights this agreement does not, and may impose conditions on copying or modifying that component. Those licences prevail over this section for the component they cover. Third-party and open-source components are provided "as is", without warranty of any kind, and we are not liable for damages arising from them. The current component and licence list is published at https://my.fabiride.com/legal/oss. Where a licence obliges us to make source available, email info@fabiride.com and we will provide it within a reasonable time, subject to any charge that licence permits for the cost of doing so.
15. Acceptable use, pairing, ownership and sharing
15.1 Acceptable use
You agree not to:
Scrape, automate, stress-test or overload the Services beyond ordinary personal use.
Attempt to access another user's account, Bike, Display, telemetry or location.
Reverse-engineer the BLE or cloud protocol for redistribution.
Use the Services to facilitate theft, unauthorised access, unauthorised modification, illegal racing or evasion of law enforcement.
Upload unlawful, infringing, abusive or harassing Content, or record or transmit another person's voice without their knowledge in a jurisdiction that requires their consent.
Impersonate anyone, or misrepresent your relationship to a Bike or Display.
15.2 Ownership and transfer
A Display has one owner account at a time. The first account to claim a Display becomes its owner.
The owner may invite shared riders (limited access) or shared admins (full access except transfer), and may revoke that access at any time.
Ownership transfers are recorded in the Cloud and confirmed by both parties. Selling or giving away a Display without transferring it in the App will leave it locked to your account.
Lost or stolen Displays can be blocked at the owner's request; reactivation requires proof of ownership. Providing false proof of ownership is fraud and will be treated as such.
15.3 Sharing a Bike — your duties to the people you share with
If you are the owner of a Bike or Display and you grant someone access:
You must tell them, before they ride, that the Bike records ride data and location, and that you as the owner can see it. This includes their GPS trail, live location while riding, ride history and telemetry.
You are responsible for the caps and limits you set on their account, and for whether those limits are appropriate for their skill, age and the law where they ride.
You must have a lawful basis for monitoring them, and you are the data controller for any monitoring you choose to perform. FabiRide provides the mechanism; the decision to use it, and its lawfulness, are yours.
Do not grant access to anyone who is not legally permitted to ride the Bike.
15.4 Crew voice chat and Content
You retain ownership of your Content. You grant us a limited licence to host, relay, transmit and process it only as needed to run the Services.
Live crew audio is relayed, not recorded by us. Anyone in the room can hear you; assume anything you say may be heard or recorded by another participant.
Voice, notifications and music mirroring are convenience features. Do not use them in a way that distracts you from riding.
We may remove Content and suspend access for breaches of §15.1.
16. Warranty, consumer rights, delivery and returns
16.1 What is covered
The Display carries the statutory conformity guarantee under EU and Lithuanian consumer law — normally two years from delivery — plus any commercial warranty stated on the box. We will, at our discretion, repair or replace a product that proves defective in materials or workmanship under normal use. Your mandatory statutory rights are not affected by anything in these terms.
16.2 What is not covered
Tamper or source-code-extraction events (§14).
Damage from incorrect installation, wiring, fitment, miswiring or bench-testing outside our documented procedure (§7.1).
Damage from use on an Unsupported Configuration (§6).
Damage from unauthorised modification, repair or disassembly.
Crash damage, water ingress beyond the stated rating, misuse, neglect, theft, loss, or damage by natural disaster.
Normal wear, cosmetic marks, and consumables.
Any legal, regulatory, warranty or insurance consequence of using our products on your vehicle (§7.3, §11).
16.3 Making a claim
Email support@fabiride.com as soon as you notice the defect, with: a description of the problem including photos or video, the product serial number, and a copy of your invoice. Do not attempt a repair before contacting us — an unauthorised repair attempt can end the warranty on the part concerned.
16.4 Delivery, transit damage, customs
Dispatch and delivery dates given at ordering are estimates. We are not liable for loss or cost caused by a missed estimate.
Check your parcel on arrival. If it arrives damaged, keep the packaging and the goods and tell us and the carrier promptly so a claim can be filed.
For deliveries outside the EU, any customs duty, import tax or clearance fee is yours to pay.
We may refuse or limit an order, and we may correct a price that was listed in error before dispatch.
16.5 Returns and right of withdrawal
If you bought directly from us as a consumer at a distance, you have 14 days from delivery to withdraw without giving a reason, per Directive 2011/83/EU. Email info@fabiride.com to start a return. Goods must come back complete, in their original packaging, in a condition allowing resale; you bear the direct cost of return unless we say otherwise. A product that has been fitted, wired in, or had its warranty seal or tamper protection disturbed may have its refund reduced to reflect the loss in value.
16.6 The Cloud
The Cloud is provided "as available" with no uptime commitment for standard accounts. Commercial and fleet customers may purchase a separate SLA.
17. Limitation of liability
To the maximum extent permitted by law:
Our total aggregate liability for all claims connected to the Services is capped at the greater of (a) the amount you paid us for the Display in the 12 months before the event giving rise to the claim, or (b) EUR 100.
We are not liable for: indirect, incidental, special, punitive or consequential loss; loss of profit, revenue, business, opportunity or goodwill; loss or corruption of data, rides, settings or telemetry; downtime; the cost of substitute goods or services; damage to your Bike, Controller, motor, battery or any third-party component; fines, penalties, prosecution costs, insurance loss or vehicle seizure; or any loss arising from your use of an Unsupported Configuration, from values you set, or from a Rider Aid failing to engage or engaging unexpectedly.
We are not liable for failures of third-party systems outside our control — your Controller and its firmware, your phone and its OS, Bluetooth, mobile networks, GPS, SMS delivery, map providers, push services, or your internet connection.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, under applicable product-liability law, or for anything else that cannot lawfully be excluded. If you are a consumer, your mandatory statutory rights always take precedence over this section.
18. Indemnity
To the extent permitted by law, you will indemnify and hold harmless FabiRide, its owners, staff and suppliers against any third-party claim, damage, loss, fine or cost (including reasonable legal fees) arising from: your riding; your configuration of a Bike; your use of the Services on an Unsupported Configuration; your breach of these terms or of any law; injury or damage you cause to another person or their property; or your grant of access to a Bike to someone else. This does not apply to the extent the claim is caused by our own gross negligence or wilful misconduct, and does not apply where you act as a consumer and mandatory law says otherwise.
19. Third-party products and services
Controllers, motors, batteries, BMS units, chargers, bikes, phones, map providers, music apps and mobile carriers are not FabiRide products. Brand names are used only to describe compatibility and imply no partnership, endorsement or approval by those manufacturers. We are not responsible for third-party products, their firmware, their defects, their warranties or their terms.
20. Fees
The core Services — App, one Display and standard Cloud — are included in the price of the Display. If we introduce paid features we will tell you in advance and they will be opt-in. We will not push an update that disables a feature you have paid for without a refund or equivalent.
We may suspend or terminate your account or a Display's cloud access immediately for: tamper or source-code-extraction events; repeated security violations; fraud, including false proof of ownership; a court or regulatory order; or use that endangers other riders or our infrastructure.
We will give reasonable notice and, where appropriate, a chance to fix the problem — unless the breach is serious, unlawful, or an immediate risk to safety or security.
On termination your licence to the software ends. Your data is handled per the Privacy Policy. Sections 5 to 19, 22 and 24 survive termination.
22. Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, war, civil unrest, epidemics, strikes, government action, power or internet outages, failures of upstream providers, or cyber-attacks.
23. Changes to these terms
We reserve the right to change these terms at any time, at our sole discretion, for example to reflect new features, new hardware, new supported configurations, security requirements, or changes in the law.
The current version always lives at https://my.fabiride.com/legal/terms and in the App under More ▸ Help & support ▸ Legal. Each version carries a version date at the top.
For material changes, we will give you at least 30 days' notice in-app or by email before they take effect.
Non-material changes — clarifications, typographical corrections, updated contact details, updated supported-configuration lists — take effect when published.
If you do not accept a change, your remedy is to stop using the Services and delete your account before the change takes effect. Continuing to use the Services after that date means you accept the new version.
We record which version you accepted, and when.
24. Governing law, disputes and general
Governing law. Lithuanian law, excluding its conflict-of-law rules.
Venue. The competent court in Kaunas, Lithuania — except that if you are a consumer, you keep the right to bring proceedings in the courts of your country of residence, and you keep the protection of the mandatory consumer law of that country.
Online dispute resolution. EU consumers may use the European Commission ODR platform at https://ec.europa.eu/consumers/odr. Before that, please email info@fabiride.com — we would rather fix it.
Severability. If any provision is held invalid or unenforceable, it is modified to the minimum extent needed to make it enforceable, and the rest stays in force.
No waiver. Not enforcing a right does not waive it.
Assignment. You may not assign these terms. We may assign them to a successor in a merger, acquisition or sale of assets, on notice to you.
Entire agreement. These terms, together with the Privacy Policy and the GDPR statement, are the whole agreement between us on this subject.
Language. The English version is authoritative. Translations are provided for convenience.
