# Terms & conditions

These terms govern your use of the FabiRide mobile app, the FabiRide bike display device, and the cloud services that connect them. By creating a FabiRide account or pairing a display you accept them in full.

## 1. Definitions

- **App** — the FabiRide mobile application (iOS / Android).
- **Display** — the FabiRide bike display device you own or are authorised to use.
- **Cloud** — the FabiRide servers backing the App and Display.
- **Services** — App + Display + Cloud, collectively.

## 2. Eligibility

- You must be **16 years or older** to create an account.
- You must comply with all local laws when using the Services, including (but not limited to) road-traffic laws and electric-vehicle power/speed regulations in your country.

## 3. Your account

- You are responsible for keeping your password and phone secure.
- You are responsible for everything done under your account.
- One account per individual. Sharing credentials is prohibited; use the **Invite rider** feature instead.

## 4. The Display

The Display is FabiRide hardware. Software running on it (firmware, fonts, UI) is licensed to you, **not sold**. You may not:

- Extract, decompile, reverse-engineer, copy, or redistribute firmware.
- Reflash firmware that did not originate from FabiRide.
- Bypass tamper-protection, secure-boot, or flash-encryption.
- Use the Display on any vehicle other than as designed and intended by FabiRide.

Tamper-protection actively detects extraction attempts. **Triggering tamper-protection void­s your warranty, locks the Display, and reports the event to FabiRide.** Repeated tamper events may result in account suspension and, depending on local law, civil or criminal action.

## 5. Acceptable use of the App

You agree not to:
- Scrape, automate, or load-test the Services beyond personal use.
- Attempt to access other users' accounts, bikes, or telemetry.
- Reverse-engineer the BLE protocol for re-distribution (decompilation for personal interoperability allowed under EU directive 2009/24/EC).
- Use the Services to facilitate theft, unauthorised modification, or illegal racing.

## 6. Pairing & ownership

- A Display has **one owner account** at a time. The first account to claim a Display becomes the owner.
- The owner can invite **shared riders** (limited access) or **shared admins** (full access except transfer).
- Ownership transfers are recorded in the Cloud and confirmed by both parties.
- Lost / stolen Displays can be blocked from the Cloud at the owner's request; reactivation requires proof of ownership.

## 7. Firmware updates

- We push firmware updates over the air (Wi-Fi or via the App). Updates may add, change, or remove features.
- You may opt in to the **Beta channel** for early access; beta firmware is provided "as-is" with reduced safety guarantees.
- We will not push an update that **disables** a paid feature without a refund or equivalent.

## 8. Safety disclaimer

**Electric bikes are dangerous. The Display shows information; it does not drive your bike.**

- Always ride within the legal limits of your jurisdiction.
- Always wear protective gear.
- The speed limiter, wheelie assist, and cruise control features are **rider aids**, not safety devices. Do not rely on them.
- The phone-as-key feature is a **convenience**, not an anti-theft device. Always use a physical lock.
- We are not responsible for damage, injury, or fines arising from misuse of the bike or the Display.

## 9. Warranty

The Display carries the manufacturer warranty stated on the box (typically 24 months, EU consumer law). The Cloud Services are provided **"as available"** with no uptime SLA for free accounts; commercial / fleet customers may purchase an SLA separately.

## 10. Payment, fees, and trials

The core Services (App + 1 Display + standard Cloud) are included with the price of the Display. We may introduce paid premium features in future with prior notice and an opt-in flow.

## 11. Termination

- You may delete your account at any time (Settings → My account → Delete account).
- We may suspend or terminate your account immediately for: tamper events, repeated security violations, court order, payment fraud, or use that endangers other riders.
- On termination, your data is handled per the Privacy Policy.

## 12. Liability

To the maximum extent permitted by law:

- Our total liability for any claim related to the Services is capped at the price you paid for the Display.
- We are not liable for indirect or consequential damages.
- Nothing in these terms limits our liability for gross negligence, wilful misconduct, or death/personal injury caused by our negligence (consumer-protection law).

## 13. Governing law & venue

These terms are governed by Lithuanian law. Disputes go to the competent court in Vilnius, Lithuania, except where mandatory consumer-protection law gives you the right to your local court.

## 14. Changes

We will notify you in-app at least 30 days before a material change. Continued use after that constitutes acceptance. The version of the terms you accepted is recorded on your account.
